Biden ordered to stop releasing illegal immigrant minors at border

A federal judge ruled that President Joe Biden’s administration must stop releasing illegal immigrant children on the southern border, according to Breitbart.

The Friday ruling could put a stop to Biden’s exemption for minors under Title 42. Invoked under former President Donald Trump, Title 42 allows for the immediate expulsion of illegal immigrants during times of emergency.

Trump invoked the regulation at the start of the COVID-19 pandemic in March of 2020.

While the Biden administration has kept Title 42 in place, it created an exemption for unaccompanied minors apprehended by authorites, who would be placed in the care of the Department of Health and Human Services.

At that point, they would be placed in the care of sponsors, generally family members already in the United States. Texas GOP Attorney General Ken Paxton was leading a challenge to the Biden administration over the policy.

In a Friday ruling, Judge Mark Pittman, U.S. District Court for the Northern District of Texas, ruled that while the Supreme Court had come to the conclusion “that the political nature of immigration generally removes it from the ambit of judicial oversight,” judicial precedent on the matter “harkens back to a quaint age when our republican form of government included a legislature that legislated.”

“But for better or worse, these decisions are now decided by individuals within the administrative state with no political accountability,” Pittman wrote in the ruling.

“And because these administrative decisions are housed in the Executive Branch, all roads — for better or worse — lead back to the President of the United States,” he continued.

“Here, the President has (arbitrarily) excepted COVID-19 positive unaccompanied alien children from Title 42 procedures — which were purposed with preventing the spread of COVID-19.” (Emphasis Pittman’s.)

“As a result, border states such as Texas now uniquely bear the brunt of the ramifications. Yet, while policy decisions are beyond judicial review, those agency actions that are ‘arbitrary, capricious, … or otherwise not in accordance with law’ will be set aside,” he wrote.

Paxton and other immigration hawks celebrated the ruling.

“Huge win against Biden! Along w (America First Legal) & (Immigration Reform Law Institute), I sued the Admin for failing to use Title 42, contrib to massive wave of smuggling,” Paxton tweeted.

“Fed court just BLOCKED Biden from excepting alien minors from the Title 42 process. Win for Texas & children—loss for Biden & cartels!”

Former Trump adviser Stephen Miller, who heads up America First Legal, also called it “a truly historic victory” in a statement.

“Biden’s decision to except UAC from Title 42, and instead mass resettle them in the United States, has led to the largest wave of criminal child smuggling in human history — and the flood of illegal alien teens and minors has drained the resources of our schools, hospitals, and communities while creating a new unimpeded recruiting pipeline for MS-13,” he said. ‘

“This preliminary injunction orders the Biden Administration to halt their order categorically excepting unaccompanied alien minors from Title 42 repatriation. This is a truly historic victory, but we have a long, long, long way to go to end the Administration’s crusade to eradicate our sovereignty.”
